1. Who we are (data controller)

ProAudioPath is operated by Konfran Investments (Pty) Ltd ("we", "us", "our"), based in South Africa. For the purposes of applicable data protection law, including POPIA, Konfran Investments (Pty) Ltd is the responsible party (data controller) for the personal information collected through this platform, and decides how and why your personal information is processed.

2. Information we collect

When you create an account, list items, buy study material or send messages we collect the details you provide — such as your name, email address, phone number, delivery details and listing content. We also collect basic usage and device information (such as IP address and log data) to keep the service secure.

When you make a payment we collect order details (items, amount and status). Card and banking details are entered directly with our payment provider, Paddle, and are never stored on our servers.

3. How we use your information

We use your information to operate your account and listings, process orders and payments, deliver in-app and email notifications about your conversations and sales, provide support, prevent fraud, and improve the platform.

4. Legal basis for processing

Under POPIA (and equivalent laws) we process your personal information where:

  • it is necessary to perform our contract with you (operating your account, listings and orders);
  • it is in our legitimate interests (securing the platform, preventing fraud and improving our service), balanced against your rights;
  • we have a legal obligation (such as record-keeping and tax); and
  • you have given consent, for example to certain marketing communications, which you may withdraw at any time.

5. Payments & Merchant of Record

Payments are processed by Paddle.com, which acts as the Merchant of Record for all our orders. This means Paddle handles the payment, billing, tax and related customer service for your purchase. Paddle collects and processes your payment information under its own privacy notice. We receive confirmation of the transaction (such as the amount and status) so we can create your order record, but we do not receive or store your full card details.

6. Sharing your information

We share limited information with:

  • other buyers and sellers, where needed to complete a transaction (for example, contact and delivery details for an order);
  • service providers who help us run the platform, such as hosting, analytics and support tooling;
  • our Merchant of Record, Paddle, for payments, subscription management, tax compliance and invoicing; and
  • authorities where required by law.

We do not sell your personal information.

7. Data security & retention

We apply reasonable technical and organisational measures — including access controls and encryption in transit — to protect your data, and keep it only as long as needed to provide the service and meet legal obligations, after which it is deleted or anonymised.

8. Your rights

Subject to applicable law, you may request access to, correction of, or deletion of your personal information, object to or restrict certain processing, and withdraw consent. You also have the right to lodge a complaint with the Information Regulator (South Africa). Contact us to exercise these rights.
